Operating Agreement for Schoolpool
Introduction
This Operating Agreement (“Agreement”) is entered into between your school, herein referred to as “the Institution,” and Schoolpool, herein referred to as “the App,” as of the date of acceptance by the Institution.
Purpose
The purpose of this Agreement is to outline the terms and conditions under which the Institution will use Schoolpool, a carpooling application designed to facilitate transportation solutions for students, faculty, and staff.
Terms and Conditions
- Acceptance of Terms
By using Schoolpool, the Institution agrees to comply with and be bound by the terms and conditions set forth in this Agreement. - User Eligibility
The Institution shall ensure that only eligible individuals affiliated with the Institution (students, faculty, and staff) utilize Schoolpool for carpooling purposes. - User Responsibilities
a. The Institution and its users are responsible for ensuring the accuracy of information provided within the app.
b. Users must adhere to all applicable traffic laws and regulations while using the carpooling services facilitated by the App.
c. The Institution will inform users that they are responsible for their personal safety and the safety of their passengers. - Privacy and Data Protection
Schoolpool is committed to protecting the privacy of its users. Personal information collected through the app will be handled in accordance with our Privacy Policy, which the Institution agrees to upon using the service. - Liability Disclaimer
a. Schoolpool provides the carpooling app as a platform to connect users and does not provide transportation services or operate vehicles.
b. Schoolpool shall not be liable for any injuries, damages, or losses incurred by users or third parties in connection with the use of the carpooling services.
c. The Institution agrees to indemnify and hold harmless Schoolpool, its affiliates, and employees from any claims or liabilities arising out of or related to the use of the app. - Insurance
The Institution is responsible for ensuring that users have appropriate insurance coverage for carpooling activities. - Termination
Either party may terminate this Agreement upon written notice if the other party breaches any of its terms and conditions. - Amendments
Schoolpool reserves the right to amend this Agreement at any time. Any amendments will be communicated to the Institution, and continued use of the app constitutes acceptance of the new terms. - Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [State/Country]. - Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether oral or written, relating to the subject matter herein.
